Summary
For the purpose of prohibiting certain plumbing materials containing more than a certain amount of lead from being used in the installation or repair of plumbing intended to dispense water for human consumption; prohibiting the sale of certain plumbing materials containing more than a certain amount of lead; requiring the State Board of Plumbing to adopt certain regulations; defining certain terms; providing for a delayed effective date; and generally relating to the lead content of materials used in plumbing. This Act shall take effect January 1, 2012.
§ 12-101 (H-1) “Lead-free” means: (1) Containing not more than 0.2% lead for solder and flux; (2) containing not more than 8% lead by dry weight for pipes and pipe fittings; and (3) containing a percentage of lead for plumbing fittings and fixtures that is in compliance with standards established under 42 U.S.C.A. § 300g–6(e) of The Federal Safe Drinking Water Act; and (4) containing not more than a weighted average lead content of 0.25% for the wetted surfaces of a pipe, pipe fitting, plumbing fitting, or fixture intended to dispense water for human consumption through drinking or cooking.

Summary
Prohibits the use of specified plumbing materials containing more than a specified amount of lead [see definition of “Lead-free” below] from being used in the installation or repair of plumbing intended to dispense water for human consumption; prohibits the sale of specified plumbing materials containing more than a specified amount of lead [see definition of “Lead-free” below]; requires the State Board of Plumbing to adopt regulations; and provides that the Act shall take effect on January 1, 2011.
This Bill affects the following Maryland Statutes: Business Occupations and Professions (12-101, 12-205, 12-605, 12-605.1, 12-605.2).
§ 12-101 (H-1) “Lead-free” means: (1) Containing not more than 0.2% lead for solder and flux; (2) except as provided in paragraph (3) of this subsection, containing not more than (I) 4% by dry weight for plumbing fittings and fixtures; or (II) 8% lead by dry weight for pipes and pipe fittings; and (3) containing not more than a weighted average lead content of 0.25% for the wetted surfaces of a pipe, pipe fitting, plumbing fitting, or fixture intended to dispense water for human consumption through drinking or cooking.
